As s tip u la te d b y Point 6 .1 . of th e Code of C o n d u ct of th e H u n g a ria n A cadem y of S ciences, a n a p p ea l a g a in s t a d e c isio n m ad e a t first in s ta n c e by th e S cien ce E th ic s C om m ittee c a n be lodged w ith th e P resid en cy of HAS as th e fo ru m of ap p eal.

1. A ppeals c a n be s u b m itte d w ith in 15 c a le n d a r days a fte r th e re c e ip t of th e re so lu tio n of th e Science E th ics C o m m ittee.

2. The a p p e a l sh all b e s u b m itte d to th e P resid en cy of the A cadem y, a d d re s s e d to th e p re s id e n t of the S c ie n ce E th ics C om m ittee.

3. The p re s id e n t o f th e Science E th ics C o m m ittee shall s e n d th e a p p ea l w ith in 30 days a fte r its receip t to th e P resid en cy of th e A cadem y, a d d re ss e d to th e P re sid e n t of th e A cadem y. H e /sh e s h a ll enclose to th e a p p ea l the re le v a n t d o c u m e n ts of th e c a se a n d h is / h e r re a s o n e d s ta n c e to th e ap p eal.

4. The P re s id e n t of th e A cadem y sh a ll call u p o n a n expert w ith th e n e c e s sa ry ex p ertise from a m o n g pu b lic b o d y m e m b e rs of HAS for th e p re p a ra tio n o f th e files m e n tio n e d in Point 3 for a sittin g of th e P resid en cy a n d for re p o rtin g th e re o n . T he notifier a n d th e d e m a n d a n t are e n title d to s u b m it a n o b ­ jectio n a g a in s t th e p e r s o n of th e ex p ert, a n d

re q u e st th e a p p o in tm e n t of a n o th e r expert.

The notifier a n d th e re s p o n d e n t c a n s u b m it a n objection a g a in s t th e e x p e rt’s o pinion. In its second in s ta n c e p ro c e d u re th e P resid en cy sh all d ecid e on th e b a s is of all available d o c u m e n ts.

In case th e p ro p o sal (objection) arriv es w ith in 15 d ay s p rio r to th e d a te of th e first p re sid e n c y s itt ing p en d in g its w o rk sch e d u le , it c a n also be ex am in ed a t th e n e x t p re sid en c y sittin g . The o b serv an ce of th e e x p e r t’s opin io n (objection) sh a ll n o t be obligatory for th e P resid en cy w hile ad o p tin g its d ecisio n of seco n d in sta n c e .

7. W ith its re so lu tio n th e P resid en cy m ay

- affirm th e decision of th e Science E th ics C om m ittee, or

- am en d th e decision of th e Science E th ics C om m ittee, or

- a n n u l th e decision of th e Science E th ics C om m ittee, a n d if n e c e s sa ry re m a n d th e Sci­

ence E th ic s C om m ittee for a new p ro c e d u re.

8. The P resid e n cy sh all, w ith reg ard to th e p o sitio n of th e Science E th ic s C om m ittee s ta te d in its re -so lu tio n of first in s ta n c e re la tin g to th e d isclo su re , decide o n th e p u b lic a tio n of its re so lu tio n on th e w eb site of th e A cadem y or in th e A cadem ic J o u r n a l.

9. R ules of in co m p atib ility

T he p e rso n s liste d below c a n n o t p a rtic ip a te in th e d e cisio n -m ak in g p ro c e d u re of th e P residency:

- th o se w ho to o k p a rt in th e a d o p tio n of th e decision of first in sta n c e ,

- th o se w ho c o n trib u te d to th e first in s ta n c e p ro c e d u re of th e SEC a s e x p erts o r w ere h e a rd a s w itn e sse s,

- th o se w ho is a close relative of th e n o tifier or th e re s p o n d e n t,

- th o se w ho is in a su b o rd in a te re la tio n w ith th e notifier o r th e re s p o n d e n t in a n y em p lo y m en t re la tio n sh ip ,

- of w hom no u n b ia s e d c o n sid e ra tio n of th e case c a n be expected b e c a u s e of a n y o th e r re a so n of in com patibility.

In co m p atib ility ru le s re la tin g to th e m e m b e rs of th e P resid en cy s h a ll be ap p lied to th e ex p ert called u p o n by th e p re s id e n t of th e A cadem y a s well.

O bjections of in co m p atib ility a g a in s t th e m e m b e rs of th e P resid en cy c a n b e s u b m itte d by

- th e notifier, - th e re s p o n d e n t,

- a n y m e m b e r of th e P residency,

- th e ex p ert in re la tio n to h i s / h e r own p e rso n .

No objection of in co m p atib ility c a n be s u b m itte d a fte r th e first p resid en cy s ittin g n eg o tia tin g th e c ase , ex cep t w h en a n in co m p atib ility o c c u rs a fte r th e h e a rin g b u t still p rio r to th e a d o p tio n of a s u b s ta n tia l decision. The objection of in co m p atib ility s u b m itte d sh a ll be decided on by th e P re sid e n t of th e A cadem y w ho sh a ll inform th e p e titio n e r of th e o b jectio n on h i s / h e r decisio n w ith in 15 d a y s after th e su b m issio n . M em bers o f th e P resid en cy sh o u ld decid e u p o n a n y in co m p atib ility re la tin g to th e P re sid e n t by voting (the P re sid e n t being ex clu d ed from th is votes).
