Article 1 OBJECTIVE

The ob jec ti ve of this Pro to col is to en han ce pub lic ac cess to in for mat ion thro ugh the es tab lish ment of co he rent, in teg ra ted, na ti on wi de pol lu tant re le a se and trans fer re gis ters (PRTRs) in ac cor dan ce with the pro vi si ons of this Pro to col, which co uld fa ci li ta te pub lic

par ti ci pa ti on in en vi ron men tal de ci si on-ma king as well as cont ri bu te to the pre ven ti on and re duc ti on of pol lu ti on of the en vi ron ment.

Article 2 DEFINITIONS For the pur po ses of this Pro to col,

1. ,,Party” me ans, un less the text in di ca tes ot her wi se, a Sta te or a re gi o nal eco no mic in teg ra ti on or ga ni za ti on re fer red to in ar tic le 24 which has con sen ted to be bo und by this Pro to col and for which the Pro to col is in for ce;

2. ,,Con ven ti on” me ans the Con ven ti on on Ac cess to In for mat ion, Pub lic Par ti ci pa ti on in De ci si on ma king and Ac cess to Jus ti ce in En vi ron men tal Matt ers, done at Aar hus, Den mark, on 25 June 1998;

3. ,,The pub lic” me ans one or more na tu ral or le gal per sons, and, in ac cor dan ce with na ti o nal le gis la ti on or prac ti ce, the ir as so ci a ti ons, or ga ni za ti ons or gro ups;

4. ,,Fa ci lity” me ans one or more ins tal la ti ons on the same site, or on ad jo i ning si tes, that are ow ned or ope ra ted by the same na tu ral or le gal per son;

5. ,,Com pe tent aut ho rity” me ans the na ti o nal aut ho rity or aut ho ri ti es, or any ot her com pe tent body or bo di es, de sig na ted by a Party to ma na ge a na ti o nal pol lu tant re le a se and trans fer re gis ter sys tem;

6. ,,Pol lu tant” me ans a subs tan ce or a gro up of subs tan ces that may be harm ful to the en vi ron ment or to hu man he alth on ac co unt of its pro per ti es and of its int ro duc ti on into the en vi ron ment;

7. ,,Re le a se” me ans any int ro duc ti on of pol lu tants into the en vi ron ment as a re sult of any hu man ac ti vity, whet her de li be ra te or ac ci den tal, ro u ti ne or non-ro u ti ne, inc lu ding spil ling, emit ting, dis char ging, in jec ting, dis po sing or dum ping, or thro ugh se wer sys tems wit ho ut fi nal was te-wa ter tre at ment;

8. ,,Off-si te trans fer” me ans the mo ve ment be y ond the bo un da ri es of the fa ci lity of eit her pol lu tants or was te des ti ned for dis po sal or re co ve ry and of pol lu tants in was te wa ter des ti ned for was te-wa ter tre at ment;

9. ,,Dif fu se so ur ces” me ans the many smal ler or scat te red so ur ces from which pol lu tants may be re le a sed to land, air or wa ter, who se com bi ned im pact on tho se me dia may be sig ni fi cant and for which it isimp rac ti cal to col lect re ports from each in di vi du al so ur ce;

10. The terms „na ti o nal” and „na ti on wi de” shall, with res pect to the ob li ga ti ons un der the Pro to col on Par ti es that are re gi o nal eco no mic in teg ra ti on or ga ni za ti ons, be const ru ed as app lying to the re gi on in qu es ti on un less ot her wi se in di ca ted;

11. ,,Was te” me ans subs tan ces or ob jects which are:

(a) Dis po sed of or re co ve red;

(b) In ten ded to be dis po sed of or re co ve red; or

(c) Re qu i red by the pro vi si ons of na ti o nal law to be dis po sed of or re co ve red;

12. ,,Ha zar do us was te” me ans was te that is de fi ned as ha zar do us by the pro vi si ons of na ti o nal law;

13. ,,Ot her was te” me ans was te that is not ha zar do us was te;

14. ,,Was te wa ter” me ans used wa ter con ta i ning subs tan ces or ob jects that is sub ject to re gu lat ion by na ti o nal law.

Article 3

GENERAL PROVISIONS

1. Each Party shall take the ne ces sa ry le gis la ti ve, re gu la to ry and ot her me a su res, and app rop ri a te en for ce ment me a su res, to imp le ment the pro vi si ons of this Pro to col.

2. The pro vi si ons of this Pro to col shall not af fect the right of a Party to ma in ta in or int ro du ce a more ex ten si ve
