Constitutional reservations to the primacy of EU law in the case law of the

German Constitutional Court

The principle of primacy of EU law is a settled principle of the EU legal order. However, national constitutional courts have put forward constitutional reservations to unconditional primacy of EU law. This lecture will give an overview of the three types of constitutional reservations to this principle as developed so far by the German Constitutional Court. It will explain the rationale, nature, and effect of these reservations. Particular emphasis will be given to the current developments and refinements in the context of the Euro crisis.

Darinka Piqani is assistant professor of EU Law at Leiden University. She is a graduate from the Law Faculty of Tirana University (Albania). After working for one year as a practising lawyer in Tirana, she pursued her LL.M studies in comparative constitutional law specializing in EU law at the Central European University (CEU), Budapest. In June 2010 she defended her PhD thesis at the European University Institute (Florence) on the supremacy of EU law and constitutional reservations in Central Eastern Europe and the Western Balkans.

Her research interests include the interaction between the EU and national legal orders, constitutional law of the EU and EU integration in the Western Balkans.

Darinka will spend a month in Budapest as visiting researcher at the Lendület-HPOPs Research Group at the Hungarian Academy of Sciences. In the framework of the research program of this project, she will be examining possibilities of re-interpretation of the primacy of EU law and its reception in national constitutional systems from the perspective of Member State interests and policy priorities.
