Understanding key concepts of protection of human rights generally and also in European regional frameworks is key for the mastery of any legal skills to be applied in the field of international relations. This is because international organizations and instruments build upon traditional notions of human rights and the regional frameworks operate in Europe as external checks on national-level protections for human rights.
The course intends to offer the students such analytical and synthetic skills, which will then they be able to use in institution-building or such other projects that will require in-depth knowledge of the comparative study of human rights protection frameworks in- and outside of Europe, of the basic functions and proceedings of such systems, of the driving forces of creating such institutional frameworks.
Course Objectives
Building upon static and dynamic knowledge to be transferred as part of this course, sets the following study results: (i) getting to know the legal way of thinking about comparing human rights and fundamental rights as well as systems created for their protection, while (ii) also gaining insight into the legal and political science approaches to the notions of fundamental rights, their evolution and their scope. As part of the course, the students will be required to put their analytical and synthetic skills to use, as they are required to work on cases during the seminars, and put together items of a Bill of Rights. Preparations for this work will be aided by the Lecture Content (through slides) and the recommended reading provided through Reading Items supplementing the lectures. As part of a PBL-approach, students might be required to form smaller groups (of 2 or 3 students) and to work on drafting a human rights provision and place it in the European system of human rights protection. This methodology seeks to reinforce and strengthen such team-work skills that is often requires from students graduated in the field of international relations, working for international organizations, NGOs or multinational corporations. Understanding problem-solving processes is therefore a core skill to be conveyed by this course along with analytical skills in understanding larger overlapping structures and overarching problem patterns.

- alkalmazni tudja a fentieket komplex, olykor interdiszciplináris megközelítést igénylő jogi–
(kül)politikai, gazdasági, etc.

A tantárgyat az a hallgató teljesítheti, aki
- Képes meghatározott idő alatt az előredefiniált feladatot elkészíteni, azt prezentálni (a bonyolultabb megítélésű ügyekben képes a szelektálásra, a lényeg kiemelésére és összefoglalására).
- Képes véleményt nyilvánítani a mások által feldolgozott problémakörökhöz, írásban benyújtott határozatokhoz kapcsolódóan.
- Képes az előadásokon problémaközpontú gondolkodásra, a megoldási javaslatainak prezentálására (logikus érvelési rendszer használatára, eredeti ötletek bemutatására).
- Összefüggésében képes látni és érzékelni az emberi jogok védelmének nemzeti és nemzetközi gyakorlatában megjelenő elvi, elméleti és persze gyakorlati dilemmákat, azokra megoldási javasatokat képes megfogalmazni.
A tantárgyat az a hallgató teljesítheti, aki
- Elkötelezett az egyéni és team munkában való együttműködésre.
- Elkötelezett egy-egy problémakör igényes szóbeli és írásbeli prezentálására.
- Kritikusan viszonyul (és álláspontját határozottan kifejezi) az alkotmányosság és az emberi jogok védelmével össze nem egyeztethető joggyakorlati megoldásokhoz, megoldási javaslatokat fogalmaz meg egyes problémák azonosítását követően.
A tantárgyat az a hallgató teljesítheti, aki
- Törekszik a félév során (az egyéni és team munkán keresztül is) folyamatos önfejlesztésre.
- A saját munkája vagy team munka vonatkozásában tett elsősorban oktatói módosítási javaslatokat elfogadja, azokat munkájába beépíti.
