Tájékoztató Information (a pályakezdõ részére)
(for career starters)
A pályakezdõ – amennyiben még nem tagja magánnyugdíjpénztárnak – köteles a biztosítottá válását köve-tõ 15 napon belül magánnyugdíjpénztárba belépni és az általa választott pénztár megnevezését, címét, bankszámlaszámát a foglalkoztatóhoz bejelenteni. Amennyiben ezen kötelezettségének e határidõig nem tesz eleget, akkor a pályakezdõ kötelezõen a lakóhelye (annak hiányában a foglalkoztató székhelye, telep-helye) szerint illetékes területi magánnyugdíjpénztár tagjává válik (irányított pályakezdõ).
Career starters are obliged to join a mandatory private pension fund – if they are not yet members of a private pen-sion fund – within 15 days from the start of social security insurance coverage, and report the name, address and bank account number of the selected fund to the employer. If the career starter fails to meet this obligation by this de-adline, the career starter shall become a compulsory member of the pertinent regional pension fund of his/her place of residence, becomes a directed career starter (or if there is none, according to the registered office/site of the employer).

**** Mandatory career starters are those natural persons who - for the first time in Hungary - are establishing an insured legal relationship in accor-dance with Article 5 of Act LXXX of 1997 or a legal relationship with an obligatory pension contribution in accoraccor-dance with Paragraph 1 of Article 26 of Act LXXX of 1997or in the absence of these, they establish an agreement for the first time in order to obtain the right for pension insurance accor-ding to the Act LXXX of 1997 / para. §34 (1) and at the time of signing the contract he/she is not yet 35 years old.

(a pályakezdõként megállapodást kötõ részére) Information
(for individuals entering into an agreement as career starters)
Pályakezdõként megállapodást kötõ természetes személy csak a magánnyugdíj-pénztári tagság létrejötté-vel, a tagsági okirat bemutatása után kötheti meg a Tbj. 34. § (1) bekezdése szerinti megállapodást. A nyug-díj-biztosítási igazgatási szervvel kötendõ megállapodás szándéknyilatkozatát, illetõleg az ennek alapján megkötött megállapodást a magánnyugdíjpénztár részére be kell mutatni.
Natural person as being a career starter, can sign the agreement (according to the Tbj 34. § (1)) only after signing the contract with the mandatory private pension fund, and after providing / showing the members-hip certificate. The letter of intent, as well as the signed contract, which is to be signed with the pension insu-rance authority must be presented to the mandatory private pension fund.

Tájékoztató a nyilatkozat kitöltéséhez
A társadalombiztosítás ellátásaira és a magánnyugdíjra jogosultakról, valamint e szolgáltatások fedezetérõl szóló 1997. évi LXXX. törvény (Tbj.) és a magánnyugdíjról és a magánnyugdíjpénztárakról szóló 1997. évi LXXXII. törvény (Mpt.) alkalmazásában:
Magánnyugdíj-pénztári tagságra kötelezett pályakezdõaz atermészetes személy, akiMagyarországon elsõ al-kalommallétesít a Tbj. 5. §-ban meghatározott biztosítási, továbbá a Tbj. 26. § (1) bekezdésében meghatározott nyug-díjjárulék-fizetési kötelezettséggel járó jogviszonyt, illetõleg ezek hiányában nyugdíj-biztosítási jogosultság érdekében elsõ ízben létesít a Tbj. 34. § (1) bekezdése szerinti megállapodást és ebben az idõpontban még nem töltötte be a 35. életévét.
A Tbj. 34. §-ának (1) bekezdése szerinti megállapodás megkötésére az abelföldi nagykorú személyjogosult, aki nem saját jogú nyugdíjas és aki a Tbj. 5. és 13. §-aiban említett biztosítási kötelezettséggel járó jogviszonyban nem áll, illetõleg akire a Tbj. 11. §-ának rendelkezései szerint a biztosítás nem terjed ki, vagy akinek a biztosítása szünetel.
Figyelem! ATbj. rendelkezéseit(a biztosítási kötelezettség megállapítása, a pénztártagság létrejötte, a járulék és tagdíjfizetési kötelezettség megállapítása stb. szempontjából)
– azEurópai Gazdasági Térségtagállamainak állampolgárai esetében, a szociális biztonsági rendszereknek a kö-zösségen belül mozgó munkavállalókra, önálló vállalkozókra és családtagjaikra történõ alkalmazásáról szóló 1408/1971. (EGK) sz. Tanácsi rendeletés a végrehajtására kiadott 574/72. (EGK) sz. Tanácsi rendelet szabá-lyaiszerint,
– a nemzetközi szociálpolitikai és szociális biztonságról szóló egyezmények hatálya alá tartozó személyekre pedig azegyezmények szabályaiszerint kell alkalmazni.
2007. március 1-jét követõen alkalmazandó szociálpolitikai, illetve szociális biztonságról szóló egyezmények a kö-vetkezõk:
– Magyar–jugoszlávszociálpolitikai egyezmény (1959. évi 20. sz. tvr.), Szlovénia, és a Horvát Köztársaság kivé-telével alkalmazni kell az utódállamokra.
– AMagyar Köztársaság és a Horvát Köztársaságközött, a szociális biztonságról szóló, Budapesten, 2005.
február 8-án aláírt Egyezmény kihirdetésérõl szóló2005. évi CXXV. törvény.
– Magyar–szovjetszociálpolitikai egyezmény (1963. évi 16. sz. tvr.). Ezt az egyezményt valamennyi FÁK tagál-lammal kapcsolatban kell alkalmazni.
– AMagyar Köztársaság és a Svájci Államszövetségközött a szociális biztonságról szóló egyezményrõl a 1998. évi VII. törvény rendelkezik, a törvényben foglaltakat 1998. január 1-jétõl kell alkalmazni.
– AMagyar Köztársaság és Kanadaközött a szociális biztonságról szóló egyezményrõl a 2003. évi LXIX. törvény rendelkezik, a törvényben foglaltakat 2003. október 1-jétõl kell alkalmazni.
– AMagyar Köztársaság és a Koreai Köztársaságközött a szociális biztonságról szóló, Budapesten, 2006. má-jus 12-én aláírt Egyezmény kihirdetésérõl szóló 2006. évi LXXIX. törvény.
– AMagyar Köztársaság Kormánya és Québec Kormányaközött a szociális biztonságról szóló, Ottawában, 2004. május 12-én aláírt Megállapodás kihirdetésérõl szóló 2006. évi XVII. törvény.
Information for filling in the declaration
Under the application of Act LXXX of 1997 on the eligibility for social security services and private pension, and co-verage of these services (Tbj.), and Act LXXXII of 1997 on private pension and private pension funds (Mpt.):
An entrant obliged to be a member of a private pension fund is a natural person who - for the first time in Hungary - es-tablishes a legal relationship with asocial security insurance obligation according to Article 5 of Act LXXX of 1997, or establishes a legal relationship with an obligatory pension contribution according to Article 26 Paragraph (1) of Act LXXX of 1997, or in the absence of the former, he/she establishes an agreement for the first time in order to obtain pensi-on insurance according to Article 34 Paragraph (1) of Act LXXX of 1997 and at the time of signing the cpensi-ontract he/she is under the age of 35 years.
Native major persons(entitled to enter into an agreement specified in Article 34 Paragraph (1) of the Tbj. are those who are not pensioners on their own rights, and are not involved in a legal relationship resulting in a social security insu-rance obligation specified in Articles 5 and 13 of the Tbj., or are not insured according to Article 11 of the Tbj., or whose insurance is ceased.
Attention! Provisions of Act LXXX of 1997 (on the establishment of the insurance obligation, establishment of fund membership, definition of contribution payment obligations, etc.)
– in the case of the citizens of the European Economic Area (EEA) shall be applied according to the provisions of Council Regulation No. 1408/1971. (EEC)on the application of social security schemes to employees and in-dependent contractors moving within the community and to members of their families, and Council Regulation No. 574/72. (EEC) on the implementation of the former regulation;
– in the case of persons who are within the scope of international treaties on social policy and social security shall be applied according to therules of the treaties.
The social policy and social security treaties applicable after March 1, 2007, are the followings:
– The Hungarian – Yugoslavian social policy treaty (Law Decree No. 20/1959), which shall be applied for the ex-Yugoslavian successor states with the exception of Slovenia and Croatia
– The Act CXXV of 2005 on the promulgation of the Treaty about the social (policy) security between the Hunga-rian Republic and the Republic of Croatia had been signed on the 8th of February 2005 in Budapest
– The Hungarian – Soviet social policy treaty (Law Decree No. 16/1963). This treaty shall be applied to all CIS member states
– The Act VII of 1998 orders about the social policy treaty between the Republic of Hungary and the Swiss Confe-deration, the provisions of whichshall be applied as of 1st of January 1998
– The Act LXIX of 2003 orders about the social security treaty between the Republic of Hungary and Canada, the provisions of which shall be applied as of the 1st of October, 2003
– The Act LXXIX. of 2006 on the promulgation of the Treaty about the social (policy) security between the Re-public of Hungary and the ReRe-public of Korea signed on the 12th of May 2006 in Budapest
– The Act XVII. of 2006 on the promulgation of the Treaty about the social (policy) security between the Govern-ment of the Hungarian Republic and the GovernGovern-ment of Quebec signed on the 12th of May 2004 in Ottawa.
